I. Introduction

If you do not accept this Agreement, you must promptly discontinue your use.

It is your responsibility to periodically review this Agreement to stay informed of updates.

III. Restrictions on Who Can Use the Website

Access or use of the Website by anyone under the age of 18 is strictly prohibited and constitutes a violation of this Agreement. If we discover that a user is under 18, we will immediately block their access and delete their account/lookup history.

IV. General Terms

Nature of the Service

The Website is a lookup engine that allows users to query public signaling data, spam registers, and carrier indicators linked to unknown phone numbers ("Public Signaling Information"). We aggregate this data from various third-party databases.

Disclaimer: We do not verify, validate, or guarantee the accuracy of this data. Carrier details and threat logs can contain errors. You accept that the Reports provided may contain inaccuracies and should not be relied upon as the sole basis for critical decisions.

Permitted Personal Use

The Website is intended only for your personal, non-commercial use. Permitted uses include:

• Checking stranger numbers before calling back or answering.
• Identifying potential spam or telemarketing caller profiles.
• Reconnecting with lost contacts.

Prohibited Activities

You agree that you will NOT use the Website or the reports retrieved to:

• Stalk, harass, threaten, or harm any individual.
• "Dox" or publish private personal details to malicious ends.
• Commit identity theft or credit fraud.
• Contact individuals against their will or engage in unsolicited telemarketing.

V. Privacy Policy

Your privacy is highly important to us. Access to the Website and use of the Services are subject to our Privacy Policy, which details how your search queries and connections are processed.

VI. End User License Agreement (EULA)

Ownership. We are the sole owner or exclusive licensee of all rights, titles, and interests related to the Website, including codebase, functionality, software, website designs, text, graphics, and marks (the "Content" and "Marks").

License to Use. You are granted a limited, non-exclusive, non-transferable, revocable license to access the Website and view lookup reports solely for your personal, non-commercial use.

Restrictions. You may not scrape, copy, reproduce, aggregate, or reverse-engineer the Reports or the Website for building a competing database, training AI models, or any commercial purpose.

VII. Prohibited Behavior

General Technical Restrictions

You shall NOT:

• Use any robot, spider, scraper, script, or other automated means to extract data from the Website.
• Bypass or circumvent security measures, CAPTCHAs, or IP-rate limits.
• Use the Website or its threat intelligence logs to train artificial intelligence (AI) models.
• Resell, distribute, lease, or use lookup reports to provide commercial lookup services to third parties.

Consequences of Violations. We actively monitor query volume. Misuse of the Website is a material breach of this Agreement. We reserve the right to terminate your access immediately without refund, and may report harassment, stalking, or FCRA violations to law enforcement agencies along with system logs.

VIII. Availability, Security, and Accuracy

Availability. We do not warrant that access to the Website will be uninterrupted, timely, or error-free. We reserve the right to update, suspend, or discontinue any features without prior notice.

Accuracy. Carrier signalling records change dynamically. We gather intelligence from public threat repositories and carrier nodes on an "as-is" basis, and cannot guarantee 100% accuracy.

IX. Subscriptions and Payments

Paid Services. Access to full lookup reports is structured as single credit locks or recurring subscription plans as detailed on our Pricing page.

Billing & Auto-Renewal. Subscriptions automatically renew at the end of each billing cycle (monthly or weekly) unless canceled. Payments are processed via our authorized Payment Processors (e.g., Paddle/Stripe), whose terms also apply.

Cancellation. You may cancel your subscription at any time to prevent future charges by utilizing the "Manage Subscription" link in your confirmation email or by reaching out to our support team. Cancellation stops future auto-renewals but does not generate a refund for the current billing period.

Refunds. Except as explicitly stated in our Refund Policy or mandated by local consumer protection laws, payments are non-refundable.

X. Third-Party Links

The reports may reference third-party carrier info or links. We do not control or assume responsibility for external web resources or privacy policies of third-party platforms.

XI. Disclaimer of Warranties

THE SERVICES, REPORTS, AND CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT IDENTITY MATCHES ARE 100% ACCURATE OR BELONG TO THE SUBJECT OF YOUR SEARCH.

XII. Limitation of Liability & Indemnification

Limitation of Liability

IN NO EVENT SHALL WHOCALLEDCHECK.COM, OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE OR REPORTS. OUR MAXIMUM LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER WILL BE LIMITED TO THE AMOUNT PAID BY YOU TO US DURING THE SIX (6) MONTH PERIOD PRIOR TO THE CAUSE OF ACTION.

Indemnification

You agree to defend, indemnify, and hold harmless WhoCalledCheck.com and our affiliates from any claims, damages, or liabilities (including attorney fees) arising from: (a) your use of the reports; (b) violation of this Agreement (including prohibited FCRA uses); or (c) infringement of third-party rights.

XIII. Legal Compliance

You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and are not listed on any U.S. Government list of prohibited or restricted parties.

XIV. Governing Law and Claims

Choice of Law and Choice of Forum

This Agreement and all disputes arising out of it shall be governed by, and construed in accordance with, the laws of the State of Florida, USA, without regard to choice of law rules. Any legal suit or proceeding shall be brought exclusively in the state or federal courts located in Florida, USA.

Class Action Waiver

WHILE RESOLVING ANY DISPUTE WITH US AND/OR SEEKING ANY RELIEF, YOU EXPRESSLY AGREE TO WAIVE THE RIGHT TO PURSUE AND/OR PARTICIPATE IN ANY CLASS ACTION LAWSUITS OR REPRESENTATIVE PROCEEDINGS.

XV. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice or liability, if you breach this Agreement.

XVI. Severability

If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be limited or eliminated to the minimum extent necessary, and the remaining terms shall remain in full force and effect.
